The revised Swiss Federal Act on Data Protection (FADP / nDSG), in force since September 2023, requires organisations outside Switzerland that process personal data of Swiss residents on a regular, large-scale basis to appoint a Swiss-based representative. This representative acts as the contact point for the Swiss data protection authority (FDPIC) and for Swiss data subjects. Common examples: global SaaS companies, e-commerce platforms, app providers, employers with Swiss staff, data analytics companies with Swiss customer data.
Switzerland is not part of the EU. If you need both EU GDPR compliance (Art. 27) and Swiss FADP compliance (Art. 14), you need two separate representatives — one established in an EU/EEA member state and one established in Switzerland.
