The revised Swiss Federal Act on Data Protection (FADP / nDSG), in force since September 2023, requires organisations outside Switzerland that process personal data of Swiss residents on a regular, large-scale basis to appoint a Swiss-based representative. This representative acts as the contact point for the Swiss data protection authority (FDPIC) and for Swiss data subjects. Who needs a Swiss FADP representative?

Organisations established outside Switzerland that:

  • Regularly process personal data of individuals located in Switzerland
  • Do so on a large scale (multiple data subjects, systematic or automated processing)
  • Process sensitive personal data of Swiss residents
  • Offer goods or services to Swiss residents, or monitor their behaviour
  • Are not otherwise established in Switzerland

Common examples: global SaaS companies, e-commerce platforms, app providers, employers with Swiss staff, data analytics companies with Swiss customer data.

Switzerland is not part of the EU. If you need both EU GDPR compliance (Art. 27) and Swiss FADP compliance (Art. 14), you need two separate representatives — one established in an EU/EEA member state and one established in Switzerland.

What the Swiss FADP representative does

  • Acts as the Swiss contact point for the Federal Data Protection and Information Commissioner (FDPIC)
  • Receives regulatory communications, inquiries and supervisory notices from FDPIC on your behalf
  • Acts as contact point for Swiss data subjects exercising their rights
  • Named in your privacy policy and data protection declarations for Swiss residents
  • Forwards inquiries to the data controller promptly
  • Can liaise with FDPIC on supervisory and advisory matters

Documents and information typically required

  • Description of data processing activities involving Swiss residents
  • Categories of personal data processed (including any sensitive data)
  • Approximate number of Swiss data subjects and frequency of processing
  • Current privacy policy (Swiss version or international)
  • Any existing FDPIC correspondence or data protection impact assessments
